UN Human Rights Expert Calls for Immediate Close of Guantanamo Detention Facility
Recently, the special rapporteur on the promotion and protection of human rights and fundamental freedoms while countering terrorism has paid a technical visit to Guantanamo detention facility and issued a report acknowledging that the U.S. has committed human rights violation such as torture, arbitrary detention, and ill-treatment against “suspected terrorists”.
The report pointed out that hundreds of Muslim detainees are being subject to human rights abuses in Guantanamo detention facility and such abuses run counter to the “Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment (CAT)” to which the U.S. is a signatory. Then it continued as follows:
The conditions of the detention facility constitute a violation of the right to available, adequate, and acceptable health care. It means that the U.S. has contravened its obligations to guarantee the right to life and the freedom from torture and ill-treatment.
This has resulted in the significant deterioration of the physical and mental health of detainees, compounding post-traumatic symptoms and other severe health consequences.
These structural deficiencies amount to, at minimum, torture, cruel, inhuman, and degrading treatment, and the U.S. government’s failure to provide torture rehabilitation also squarely contravenes its obligations under the Convention.
She also condemned the U.S. government for neither issuing an apology nor making reparation, despite having previously authorized and enabled torture practices and serious violations of international human rights.
Human rights violations are still ongoing in the detention facility as the U.S. government has not instituted robust legal and administrative safeguards to prevent future abuses.
Reiterating that any violation of international law gives rise to an obligation to make reparation and that there is no statute of limitations for gross and systematic violations of international human rights law and serious violations of international humanitarian law, she demanded that the U.S. government immediately closes detention facility and brings to account all those who ordered, enabled, facilitated, carried out, suppressed knowledge of, and obscured torture.
In conclusion, she stressed that the U.S. government must ensure accountability before international community for all human rights violations against international law including extraordinary rendition, arbitrary detention, systematic torture, cruel, inhuman, and degrading treatment or punishment.

Una especialista de derechos humanos de la ONU exige a EE.UU. el cierre inmediato del campo de concentración de Guantánamo
Hace poco, la relatora especial del antiterrorismo y derechos humanos del Consejo de Derechos Humanos de la ONU realizó una averiguación sobre el campo de concentración de Guantánamo en el terreno y publicó un informe que reconoció que EE.UU. había perpetrado violaciones de derechos humanos de los “sospechosos del terrorismo” como torturas, prisión ilegal y extradiciones ilegítimas.
El informe señaló que, en Guantánamo, fueron perpetradas de manera continua gravísimas violaciones de derechos humanos de los encarcelados islámicos y que tales actos contravienen a la “Convención contra las torturas y otros tratos y castigos crueles, inhumanos e infames”, de la cual EE.UU. es un país interesado.
Las condiciones de vida del campo de concentración no podían garantizar el nivel necesario de salud a los encarcelados, y esto demuestra que EE.UU. violó la obligación del país interesado en cuanto al respeto al derecho a la vida y la prohibición de las torturas y maltratos.
Como resultado, los encarcelados están sufriendo duras penas por las secuelas de las lesiones externas y otros problemas de salud porque sus situaciones físicas y mentales están muy deterioradas.
Desde el punto de vista mínimo también, tales fenómenos son claramente torturas y tratos crueles, inhumanos e infames, y el proceder de las autoridades que no tomaron medidas de recuperación de las víctimas también constituye una obvia violación de la Convención.
A continuación, la relatora especial denunció diciendo que a consecuencia de que el gobierno norteamericano no pide disculpas ni recompensa a las víctimas ni toma las medidas para prevenir los actos de violación de derechos humanos legalizando y promoviendo las torturas y otros actos de violación de derechos humanos, hoy día no cesan los actos de violación de derechos humanos en el campo de concentración.
Y ella planteó que las violaciones del Derecho Internacional deben pagar el precio sin falta y los serios actos de violación de derechos humanos que han violado sistemáticamente la ley internacional de derechos humanos y las normas humanitarias internacionales no prescriben y exigió que el gobierno norteamericano cerrara inmediatamente el campo de concentración y reprochara la culpa a todas las personas interesadas que han ordenado, incitado, promovido, ejecutado y ocultado los actos de tortura.
Por último, ella enfatizó que el gobierno norteamericano tiene que cargar con la debida responsabilidad ante la sociedad internacional por haber perpetrado los actos de violación de derechos humanos que contravienen al Derecho Internacional como la ilegítima extradición y el ilegal encarcelamiento, las sistemáticas torturas y los tratos y castigos crueles, inhumanos e infames.

Недавно, специальный докладчик по антитерроризму и правам человека ознакомилась на месте с ситуацией в лагере Гуантанамо и опубликовала доклад, который признал Соединенные Штаты в совершении актов нарушения прав человека в отношении «подозреваемых террористов», таких как пытки, незаконные тюремные заключения и притеснения заключенных.
В докладе отметили, что в лагере Гуантанамо продолжительно совершались сугубо серьезные акты нарушения прав человека в отношении сотен исламских заключенных и эти акты противоречат «Конвенции против пыток и других жестоких, бесчеловечных или унижающих достоинство видов обращения и наказания», которую подписали сами США.
Доклад продолжал:
Жизненные условия в лагере достигали такого уровня, что невозможно обеспечить здоровье заключенных на должном уровне, а это показывает, что США как член-государство конвенции нарушили свое обязательство – уважать право на жизнь и запретить пытки и притеснения.
В результате физическое и моральное здоровье у заключенных серьезно ухудшилось, и они заявляют о вопросах по здоровью, включая последствие травмы и другие симптомы.
Такие явления по минимум принадлежат пыткам, жестоким, бесчеловечным и унижающим достоинство видам обращения, а поступки правительства, не принявшего меры для выздоровления потерпевших, тоже являются очевидным нарушением конвенции.
В продолжение спецдокладчик осудила, что до сих пор акты нарушения прав человека в лагере не прекратились из-за того, что США узаконивают и содействуют пыткам и другим актам нарушения прав человека, не приносят никаких извинений или компенсаций и не принимают никаких гарантирующих мер, которые могли бы предотвратить нарушения прав человека в будущем.
Спецдокладчик утвердила, что за каждое нарушение международного закона нужно дорого расплатиться, а серьезное попирание прав человека, систематически нарушающее международный закон по правам человека и международные гуманистические правовые нормы, не имеет срока давности.
Дальше она требовала от правительства США немедленно закрыть лагерь и привлечь к ответственности всех виновных, кто распоряжался, провоцировал, поощрял, исполнял и укрывал пытки.
В заключение спецдокладчик подчеркнула, что правительство США должно нести должную ответственность за совершение актов нарушения прав человека, которые противоречат международным правам, в том числе нелегальные передачи, незаконные тюремные заключения, системные пытки и другие жестокие, бесчеловечные и унижающие достоинство виды обращения и наказания.

联合国人权问题专家要求美国立即关闭关塔那摩集中营
前不久,联合国人权理事会反恐与人权问题特别报告员通过对关塔那摩集中营的现场调查发表报告,认定美国针对“恐怖袭击嫌疑人”进行拷打、非法监禁、虐待囚犯等人权蹂躏行为。
报告指出，关塔那摩集中营针对数百名伊斯兰教徒囚犯不断肆行严重的人权蹂躏，这些行为违反“关于禁止拷打和非人道、不光彩的对待和处罚的协定”，美国就是该协定的当事国。
然而，当前集中营无法给囚犯保障最低健康水平的生活条件，这表明美国违反了关于尊重生命权、禁止拷打和虐待行为的当事国的义务。
结果，囚犯的身体与精神健康日益恶化，因外伤后遗症和其他健康问题遭受折磨 。
很显然，这些现象最起码属于拷打、残忍和非人道、不光彩的对待，同时当局对受害者没有采取恢复措施也分明是对协定的触犯。
特别报告员还谴责称，美国政府助长拷打等其他人权蹂躏行为，并把这些行为加以合理化，没有对受害者做出任何谢罪和补偿，没有采取措施防止将来发生的人权蹂躏行为，结果，集中营的人权蹂躏行为仍在继续。
他还说，违背国际法必将付出其代价，系统性地违背国际人权法与国际人道主义规范的严重的侵犯人权行为并没有时效，他敦促美国政府立即关闭集中营，对命令、催促、奖励、实施、隐蔽拷打行为的所有当事者追究责任。
最后，他强调美国政府理应在国际社会面前为不法引渡，非法监禁，系统性的严刑拷打，残忍、非人类、不光彩的对待与处罚等有悖于国际法的人权蹂躏行为负起应当的责任。
